Abstract

The Constitutional law guarantees the right to litigation for all and allocates the form by which individuals claim their rights, which is the lawsuit, to a set of guarantees that guarantee the smooth conduct of the dispute. It specifies a set of formalities so that individuals can be assured of the validity of the procedure taken by both parties. However, the procedures for examining the dispute or the sentences issued It may be affected by a group of defects that lead to a violation of the right subject to the sentence, so the law has organized the description that affects the invalid sentence or procedure, the methods of adhering to it and correcting it, and the effects resulting from the sentence, in which it is necessary to differentiate between the defects that affect the validity of the condition and invalidate it, and those defects that affect the validity of the condition and invalidate it. If the element is eliminated, it makes the sentence non-existent from its inception. Therefore, this research is divided into two sections, the first of which deals with invalidation, its causes, the way to uphold it, and its effects, while the second section is devoted to studying annulled sentences, their causes, the way to uphold them, and their effects, which led to a series of results, the most important of which is that Omani law did not regulate annulled sentences, but rather made sentences invalid and uncorrectable. Omani law did not then regulate the means of adhering to them and the effects resulting from them, but rather made them like invalid sentences in terms of the means and effects.
